VisualVia.com is a service of Access Arts, Inc. a service company located in the United States. All references in this “Terms of Service” (“TOS”) agreement is between Access Arts, Inc,, known as Visualvia.com (the “web site”) or “we” (“We”). By using this service you agree to all the terms and conditions set forth under this TOS.

All payments made for services (or goods) on the VisualVia.com site will be paid to "Access Arts, Inc.".

We may amend this agreement at any time without notice to you. You can review the most current version of the TOS at any time on this web site.

MEMBERSHIP AND FEES

Members must be 18 years of age to open a Membership. Members may only have ONE FREE basic account. A member is allowed to have as many PAID accounts as he/she wish’s. Any additional FREE accounts that a members signs up for will be deleted from server without warning.

ALWAYS KEEP COPIES OF YOUR IMAGES, WE ARE NOT RESPONSIBLE FOR MAINTENANCE AND RETRIEVING OF PERSONAL IMAGES THAT MAY BE LOST DUE TO TECHNICAL REASONS, EITHER AS A RESULT OF YOUR ACTIONS OR THE SERVICE.

If you sign up for a FREE limited VisualVia.com membership or a PAID VisualVia.com membership, you warrant that all information that you submit is true and accurate. Including without limitation your credit card number and expiration date, and you agree to pay all fees you incur plus any applicable taxes. All fees and charges will be at the rates in effect at the time the charges were incurred. You are responsible for paying all fees, charges and applicable taxes associated with your use of the VisualVia.com Service. All amounts appearing on the Web Site are quoted in US dollars.

In the event legal action is necessary to collect on balances due, you agree to reimburse VisualVia.com for all expenses incurred to recover sums due, including reasonable attorney fees and other legal expenses. You are responsible for purchase of, and payment of charges for, Internet Access Services and Telecommunications Services needed for use of the VisualVia.com membership service. All fees are shown in US dollars and do not include local connection and telephone charges, which may be applicable to you.

PROHIBITED by VisualVia.com

The following non-exclusive list of images that are unlawful, offensive, pornography, sexually explicit, sexists, racist, hateful, offensive, harassing, obscene, defamatory, fraudulent, deceptive, harmful, abusive, threatening, vulgar, profane, invasive of the privacy rights of others, or other wise objectionable. This prohibition extends to the posting of any Materials that depict, encourage indicate, advocate or tend to incite any such conduct.

COPYRIGHTS

VisualVia.com claims NO OWNERSHIP rights in any image contained in any of your photo albums. However, users of VisualVia.com must agree to comply with all laws, including copyright and trademark laws. Images and files that violate copyrights or trademarks are not allowed. If someone has an infringement claim against you, you will be asked to remove the copyrighted file until the issue is resolved.

If you suspect a copy right infringement please contact Support@VisualVia.com.com and provide detail information to where it is located on the site.

It is VisualVia.com's policy to report suspected illegal activities to law enforcement agencies and to cooperate fully with their investigations.

TERMINATION OF SERVICE

If you breach any provision of this Agreement, then you may no longer use the VisualVia.com Service.

If you do not renew your membership before the expiration date, your membership, all files and images, will be terminated automatically on or after your expiration date.

Free accounts will be deleted following 48 hours of initial sign-up if not activated or used, or after 90 continuous days of inactivity.

It is against VisualVia.com  policy to provide any customer information to any third party without the customer's prior permission. VisualVia.com is not responsible for the use of any customer information that customers provide to any of these third party individuals and companies and ArtDeadline.Com disclaims any responsibility for their actions.

MODIFICATIONS TO SERVICE

VisualVia.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that VisualVia.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

TERMINATION

You agree that VisualVia.com , in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if VisualVia.com believes that you have violated or acted inconsistently with the letter or spirit of the TOS. VisualVia.com may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that VisualVia.com may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that VisualVia.com shall not be liable to you or any third-party for any termination of your access to the Service.
